Infringing MetaBerkins NFTs May Appear in Museum with Disclaimer
An artist can give his permission for his MetaBirkins NFT to be displayed in a Swedish museum if the exhibit prominently notes that a jury found it infringed on Hermès International SA’s Birkins bag trademarks, a federal judge has ruled.
Mason Rothschild, whose real name is Sonny Estival, initially failed to guarantee the blessing of the US District Court for the Southern District of New York to give the museum permission to display the NFT. But the court reconsidered after he obtained sworn statements that it was clear a jury found he intentionally tried to deceive the public.
